Abstract

Drug abuse remains one of the most persistent socio-legal challenges confronting Pakistan, with several national surveys indicating that millions of adults use one or more controlled substances annually. This paper argues that Pakistan's drug abuse crisis is not merely a failure of criminal-law enforcement; it is fundamentally a crisis of justice administration. Without timely adjudication, reliable forensic evidence, constitutionally compliant procedure, and rehabilitation-oriented sentencing, even the most stringent narcotics legislation cannot achieve deterrence, public safety, or sustainable social recovery. Drawing on statutory material, published conviction and incarceration statistics, landmark case law, constitutional and international human-rights instruments, and comparative judicial models from Portugal, the United States, Singapore, the United Kingdom, Canada, Australia, and Thailand, the paper situates judicial reform as the indispensable foundation — rather than a peripheral policy option — of an effective national response to drug abuse. It documents a collapse in narcotics conviction rates in major Punjab cities, chronic prison overcrowding disproportionately driven by drug-related incarceration, and unresolved federal-provincial coordination gaps traceable to the Eighteenth Amendment, before proposing a reform agenda sequenced into immediate, medium-term, and structural priorities.
