Transgender Voice and Identity Law in Islam: A Critical Literature Review

Transgender identity varies in meaning among individuals. There is no
singular method to be transgender, nor is there a uniform appearance or
self-perception among transgender individuals. This research aims to
comprehend the intrinsic worth of transgender individuals from an
Islamic perspective. Our Prophet cared for transgender individuals,
granted them respect, prohibited their mistreatment, and consistently
acknowledged the positive attributes of spiritually inclined transgender
persons. If we are genuine Muslims, why do we not adhere to the
commands of our Prophet? During the Mughal Empire, transgender
individuals were afforded unique privileges. Thematic data analysis was
used to integrate qualitative data from previous literature, and acquired
a comprehensive and dependable representation of the transgender
identity and voice in Islam. It was discovered that transgender endured
significant suffering. Societal pressure includes harassment and bullying
at educational institutions, leading to potential termination or denial of
employment, resulting in homelessness or severe poverty. Access to a
refuge is denied to them. Transgender are deprived of essential medical
treatment and subjected to law enforcement targeting. It is necessary to
recognize that being transgender is not a disorder, and the notion that
transgender individuals must confront physical and mental health issues
requires revaluation. Transgender individuals need decency, respect,
and equal rights in society.
